New Brunswick Property Insurance Loss Lawyers
Coverage Denied?
We purchase insurance policies to protect our property against fires, water damage, theft, and other perils. However, when a loss occurs, often the insurer will find a way to avoid paying.
There are many ways an insurance company will avoid payment, such as:
claiming you don’t have the right ‘endorsement’
claiming the loss is due to a peril that is not covered, when it is actually due to a covered peril
claiming a property was vacant
claiming the homeowner made a ‘material change in risk’ to the property, when they did not in order to exclude coverage
If your claim has been completely denied by the insurer, call us. We’ll fight for what you deserve. There’s no fee, and we don’t get paid until we put money in your pocket.

D.B.
Andrew helped me navigate a minor legal dispute with a large organization.
He patiently took the time to listen to my concerns, answered all of my question and asked follow-up or clarifying questions to ensure he had the full picture and context of the situation I was in. He explained all of my options in way that was very clear and very easy to understand, then offered a sound legal opinion on our best course action. As a result, we won the dispute!
Andrew’s service was excellent throughout the entire process. He was knowledgeable, responsive and very prepared.
If you ever need a lawyer, I strongly recommend you give him a call.

Replacement Cost VS Actual Cash Value
Another way an insurance company will lower your claim is applying an ‘actual cash value’ to your claim instead of replacement value.
Simply put, Replacement value is what the item or property is worth if you were go to the store today and purchase the item new.
Actual Cash Value is what you would be able to sell the item for on Kijiji or Marketplace.
Obviously, this is a huge difference in price.

It's typically a good idea to report property damage to your insurance company as soon as possible. However, each policy might have different terms, so make sure to review your specific policy or consult with a professional if you're unsure.

It's important not to admit fault or make definitive statements about the cause of the damage before a thorough investigation has been completed. You should also avoid providing a recorded statement without consulting with a legal professional first.

No, at Moss Hachey Law, you don't have to pay any fee upfront for a property insurance loss claim. We work on a contingency fee basis, which means we only get paid when we successfully get compensation for you.
Why Work With Us?
Knowledgeable
We used to work for some of Canada’s largest insurance companies, representing them against individuals such as yourself. We know the insurance industry’s personalities, practices and culture. Now, we work exclusively for individuals with their personal injury claims. We know how the insurers work, and we know how to help your claim.
Accessible
Our office location is based on the needs of our clients, who want easy access. Our office is all on one level and is wheelchair accessible with free parking. No worries about parking garages, small elevators or multiple flights of stairs, we can accommodate you at any stage of your injury.
Client Focused Pricing
We strive to find the best billing structure for our clients, whether it be a traditionally hourly rate, a contingency fee agreement, or a flat fee. Hourly fee agreements are reserved for certain litigation work, where we work with the client to find the result best suited for their unique situation. With our contingency fee model, the client pays nothing until a settlement or judgment is reached. If the client does not receive a settlement, then we are not paid for our fees. For our more standardized work, such as drafting wills or notarizing documents, we have a flat fee structure for client budgeting. Overall, we will work with our clients to find the best fee structure possible.
Innovative
Traditional law firms rely on paper only systems despite modern software being available. We try to always be ‘paperless as possible’ at our office, which reduces environmental waste. We are always looking for new ways to modernize our practice as our office grows.
Community Oriented
We work hard at our office, however we work hard for our greater community as well. All lawyers are involved in various community groups, law education, and provide feedback to the public. We also provide free 15 minute consultations for legal issues and information within our practice area. We also write a legal blog [link] on various legal issues which are of interest to our clients.
